These Terms & Conditions apply to the Promotion conducted by the Promoter. By participating, you agree to be bound by these Terms & Conditions. All decisions made by the Promoter are final. The Promotion is in no way sponsored, endorsed, or administered by BMW, and Entrants agree to hold BMW harmless from any claims, loss, or damage.

All Entries must comply with these Terms. Automated entries, AI-generated entries, and third-party entries are prohibited. Multiple identities or shared email addresses will void all of an Entrant's Entries. Incomplete, illegible, or untimely Entries are void. The Promoter is not responsible for lost, late, or misdirected Entries.

The Prize must be accepted as offered and claimed per Item 10. It cannot be resold, transferred, exchanged, or redeemed for cash, or used for any commercial purpose. The Winner is solely responsible for all applicable taxes. If the Prize or part thereof is unavailable, the Promoter may substitute a prize of equal or greater value.

You must not tamper with the Promotion; engage in disruptive, threatening, or harassing conduct; use automated entries; or damage the reputation of the Promoter or its partners. The Promoter may require verification documentation at any time. Breach may result in disqualification.

To the fullest extent permitted by law, the Promoter is not liable for any personal injury, death, losses, or damages resulting from participation or use of any Prize. UK Entrants: Nothing in these Terms limits or excludes the Promoter's liability for personal injury or death caused by negligence, or for fraud, or any matter where liability cannot lawfully be excluded.

The Promoter may end, amend, suspend, or cancel the Promotion if it cannot be conducted due to circumstances beyond its control. Total aggregate liability is limited to amounts paid by the Entrant in the three months preceding the relevant claim.

By submitting an Entry, you grant the Promoter a non-exclusive, royalty-free, perpetual, irrevocable, worldwide, and fully sublicensable right to use, reproduce, modify, and distribute your Entry content without attribution. You warrant that you hold all relevant intellectual property rights and that use by the Promoter will not infringe any third-party rights.

The Promoter may request proof of identity or residency from any Winner. The Promoter may modify or cancel the Promotion in its absolute discretion. The Promoter reserves the right to disqualify any Entrant who has breached these Terms, tampered with the entry process, or engaged in unlawful conduct.

The Promotion is in no way sponsored, endorsed, or administered by Instagram or Facebook. You release Facebook, Instagram, and their related entities from all liability in connection with the Promotion. You must not harass others, use bots, use multiple accounts, or tag accounts you control.

Nothing in these Terms restricts any consumer rights under the Competition and Consumer Act 2010 (Cth), the Federal Trade Commission Act (US), or their German and UK equivalents. This Promotion is governed by the laws of all Australian States and Territories in which the Promotion is conducted. Any dispute shall be subject to the jurisdiction of the Victorian Courts in Australia.

The Winner's last name, first initial, and postcode will be published on the Site for 10 days from the date the Winner is confirmed. After that, email contact@444racingco.com within two months of the closing date for Winner details. UK Entrants may object to public disclosure by contacting the Promoter — the Promoter may still disclose information to the UK Advertising Standards Authority if required.

Entrants must abide by these Official Rules and the Sponsor's decisions, which are final and binding subject to mandatory applicable law. You must not tamper with the Promotion; engage in disruptive, threatening, or harassing conduct; use automated entries or aliases; or damage the reputation of the Sponsor or its partners. The Sponsor may disqualify any Entrant at its sole discretion who has breached these Rules, tampered with the entry process, or engaged in unlawful or improper conduct.

If the Promotion cannot be conducted for reasons beyond the Sponsor's control (including technical failure, tampering, fraud, or acts of God), the Sponsor may end, amend, suspend, or cancel the Promotion, or disqualify affected Entries. All Sponsor decisions are final.

The Sponsor shall be liable for damages in the event of intent and gross negligence. In the event of slight negligence, the Sponsor is only liable for:

• Damages arising from injury to life, body, or health;
• Damages arising from breach of a substantial contractual duty (Cardinal Obligation) — limited to typically foreseeable damage.

No limitation of liability applies where a defect has been fraudulently concealed, a quality guarantee has been given, or in the case of claims under the German Product Liability Act. Any limitation of liability also applies to the Sponsor's vicarious agents and employees.

Should any provision of these Official Rules be or become invalid or unenforceable, the remaining provisions shall remain in full force and effect.

All questions concerning the construction, validity, interpretation, and enforceability of these Terms & Conditions, or the rights and obligations of the Entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of Germany.

The Sponsor is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
