Service
The rules of the road between you and us. Ordering from a drop means you've read and accepted these terms, together with our Shipping Policy, Returns & Refunds Policy and Privacy Policy, which form part of them.
The agreement
These terms are between you and 444RacingCo Pty Ltd (ACN 691 144 046), an Australian company based in Melbourne. By using 444racingco.com or placing an order you accept these terms. Giveaways and competitions run under their own published terms, which apply in addition to these.
Orders & pre-orders
Placing an order is an offer to buy. Our acceptance happens when we dispatch your order; a confirmation email acknowledges receipt of your order, not acceptance of it. Drop purchases are pre-orders made to order after the drop closes, on the timeline in the Shipping Policy.
- We may cancel any order before dispatch, with a full refund to your original payment method, where we reasonably suspect fraud, where a pricing or description error occurred, where stock or production constraints require it, or where the order breaches Clause 04.
- Obvious pricing errors don't bind us. If we catch one on your order before dispatch we'll contact you with the option to pay the correct price or take a full refund.
- Cancellation by you is governed by the Returns & Refunds Policy (48-hour window).
Pricing & payment
Prices are displayed in the currency shown at checkout and include any taxes we're required to collect at the point of sale. Import charges on international orders are your responsibility per the Shipping Policy. Payment is taken at checkout through Shopify Payments, PayPal, Afterpay or Klarna, each under its own terms. We may change prices between drops at any time; changes don't affect orders already placed.
Bots, limits & resale
Drops are limited and made for riders, not resellers. By ordering you agree that:
- No automated purchasing. Bots, scripts, headless browsers or any automated means of placing orders or holding checkout inventory are prohibited.
- Order limits apply. Unless a drop states otherwise, orders are limited to 10 units per product per customer. Multiple accounts, addresses or payment methods used to evade limits count as one customer.
- No commercial resale. Purchasing for the purpose of bulk commercial resale is prohibited. Selling on your own gear second-hand is obviously fine.
- We may cancel orders, reverse discounts and block accounts that breach this clause, refunding any amounts paid for cancelled orders.
Discounts & offers
Discount codes apply one per order unless stated otherwise, can't be applied retroactively, and have no cash value. Volume offers (such as free items at quantity thresholds) run on the terms published with each drop; free items are subject to the free-item terms in the Returns & Refunds Policy. Store credit has no cash value, isn't redeemable for cash except where the law requires, and is void if obtained through fraud or abuse.
Your content
When you tag us, use our hashtags, or send us photos or videos featuring our gear, you grant 444RacingCo a worldwide, royalty-free, non-exclusive licence to repost and use that content on our site, social channels and marketing, with credit where practical. You confirm you own the content or have the right to share it. Want something taken down? Email contact@444racingco.com and we'll remove it from channels we control.
Our intellectual property
Everything on this site and everything we make, including the 444RacingCo name and marks, designs, artwork, product photography, page code and copy, belongs to 444RacingCo Pty Ltd or its licensors. Buying a product gives you the product, not a licence to reproduce its design. Counterfeiting, copying our designs, or ripping site assets will be pursued.
Acceptable use
Don't interfere with the site's operation or security, scrape it, probe it, misrepresent who you are, or use it for anything unlawful. We may suspend access for breaches. Our gear is apparel and streetwear; reflective and hi-vis elements aid visibility but nothing we sell is protective equipment unless its product page expressly states a certification, and you're responsible for wearing gear appropriate to your riding.
Consumer guarantees & liability
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or the mandatory consumer law of your country. To the extent the law permits: our liability for any claim not covered by a non-excludable guarantee is limited, at our option, to resupplying the goods or refunding the price paid; and we're not liable for indirect or consequential loss. Timeframes in our policies are estimates and delays outside our reasonable control (carrier disruption, customs, force majeure events) don't constitute a breach.
Governing law & changes
These terms are governed by the laws of Victoria, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of Victoria. If you're a consumer, nothing in this clause deprives you of the protection of mandatory consumer laws, or your right to bring proceedings, in your country of residence.
We may update these terms from time to time; the version published at the time you place an order is the one that applies to it. If any part of these terms is found unenforceable, the rest stays in force.
