Odds of Winning: Your odds of winning depend on the total number of eligible entries received.
The Prize: There will be 1 winner.
1. Australian Residents: If the winner is an Australian resident, the winner will win 1 x 2025 Yamaha R1 in Black, approximate retail value (“ARV”): AUD $25,000.
2. UK, Swiss, German, French and USA Residents: If the winner is a resident of the UK, Switzerland, Germany, France or the USA, the winner will win 1 x AUD $25,000 / approximately equivalent to £13,255 / 14,598 CHF/€ 15,445 /US$ 17,825.
The winner will receive the relevant conversion into their currency based on exchange rates at the time of Prize fulfilment.
Further Prize Details & Conditions:
1. Australian Residents:
  1. The Prize will be delivered to the winner’s home address.
  2. The winner is responsible for obtaining the relevant tax and insurance cover for the motorbike.
  3. Maintenance, services and running costs of the motorbike are the responsibility of the winner from the date of ownership. This date will be confirmed with the winner in writing following winner acknowledgement of the Prize.
  4. Motorbike warranty will vary dependent on the Prize. Warranty and its duration will be confirmed with the winner before delivery.
  5. Any pictures depicting the Prize on any media including press advertisements, posters or TV commercials are indicative only and the actual prize may vary from the depictions. The Promotion does not constitute an endorsement or recommendation of the product being offered as a Prize.
  6. The Prize must be taken as stated and no compensation will be payable if a winner is unable to use the Prize as stated. The winner will be liable for all costs and expenses not stated relating to claiming the Prize.
2. UK, Swiss, German, French and USA Residents:
  1. The winner will receive the Prize via bank transfer.
  2. The winner must have a valid local bank account.
  3. The winner is responsible for providing correct bank account details and the Promoter will not be liable for any Prize payments made into the wrong bank account.
Winner Selection: 1 provisional winner will be randomly selected from all valid entries received during the Promotion Period. The Prize draw will be conducted by PromoVeritas at Monument House, 215 Marsh Road, Pinner, London, HA5 5NE, UK, at 12:00 PM BST on 22 October 2026, and simultaneously at the Promoter’s address UNIT 2 12 LAMBOURN ROAD WATSONIA VIC 3087.
Unclaimed Prize Draw: If the Prize is unclaimed 28 days after the close of the Promotion Period, an Unclaimed Prize Draw will take place from all non-winning valid entries by PromoVeritas at Monument House, 215 Marsh Road, Pinner, London, HA5 5NE, UK, at 12:00 PM GMT on 11 November 2026. The provisional winner of the unclaimed Prize will be notified via the email address and/or mobile number provided on entry within 5 working days of Winner Selection and will be subject to the Winner Notification and Prize Acceptance terms outlined in clauses 17, 18 and 19.
Winner Notification: The provisional winner will be contacted via the email address and/or mobile number provided on entry within 5 working days of Winner Selection and may be asked to provide evidence of identity and eligibility. Reasonable efforts will be made to contact the provisional winner. Once eligibility has been confirmed, a provisional winner will be confirmed as a winner. If the provisional winner does not respond to the initial contact within 14 days, we reserve the right to disqualify that entrant and award the Prize to a reserve selected in the same manner. A reserve winner may have less time to respond.
For USA Residents only: Upon the request of the Promoter, any provisional winner may be required to complete and return a Declaration of Eligibility, Waiver of Liability and, except where prohibited by applicable law, Publicity Release Forms (collectively, the “Release Forms”) within 14 days after the date such Release Forms are sent to the potential winner, in accordance with the Promoter’s instructions. If a provisional winner does not respond to the initial contact within 14 days or provide the Release Forms, as applicable, within the requested time period, the Promoter reserves the right to disqualify that provisional winner. If a provisional winner is disqualified, the Promoter reserves the right to award the Prize to a reserve winner selected in the same manner, time permitting.
Prize Acceptance: Fulfilment of the Prize will take place within 28 days of acceptance of the Prize. In the unlikely event that the Prize does not arrive within this timeframe, the winner must inform the Promoter by emailing contact@444racingco.com within a further 28 days. If the winner does not do so, the Promoter reserves the right to not reissue the Prize at its sole discretion.
Provided no objection is received from the winner, a winner list containing the first initial, surname and postcode/ZIP code of the winner will be made available by the Promoter 4 weeks after the close of the Promotion Period, for a period of 8 weeks. It will be available at 444racingco.com. Winners can object to their details being published during the Winner Notification process. Without prejudice, the Promoter will provide winner information to the relevant authorities when requested by them.
Tax Obligations:
1. For USA Residents only: The fair market value of any Prize amount valued at or over USD $2,000 will be reported on IRS form 1099-misc and issued to the recipient. Tax identity information will be collected by completing IRS form W-9 for all winners of Prizes awarded which are valued at or over USD $2,000.
2. For Australian, UK, Swiss, German and French Residents: There may be additional or equivalent tax forms required to be issued based on the winner’s country of origin. A winner may be required to sign and return certain tax documentation. Where applicable, the Promoter may require the winner to provide additional tax information, as required by law. Unless otherwise specified, all winners will be responsible for any applicable taxes related to the acceptance of any Prize.
The Promoter may request that the winner participates in publicity arising from the Promotion. Participation is at the winner’s discretion and is not a condition of Prize Acceptance.
Failure of the Promoter to enforce any term of these Terms & Conditions shall not constitute a waiver of that provision and such provision shall remain in full force and effect. In the event of any conflict with any Promotion details contained in these Terms & Conditions and the Promotion details contained in any Promotion materials (including, but not limited to, point of sale, television and print advertising, or any other Promotion media), the details of the Promotion as set forth in these Terms & Conditions shall prevail.
Limitation of Liability for Australian, UK, Swiss, German and French Residents: By participating in this Promotion, entrants and the winner agree that the Promoter and each of their respective affiliates, subsidiaries, representatives, consultants, contractors, legal counsel, advertising, public relations, fulfilment and marketing agencies, website providers and each their respective officers, directors, stockholders, employees, representatives, designees and agents (the “Released Parties”) shall not have any liability for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Promotion or accepting or using the/a Prize(s), except for any liability which cannot be excluded by law. Nothing shall exclude the Released Parties’ liability for death and personal injury as a result of the Released Parties’ negligence.
Limitation of Liability for USA Residents: By participating in this Promotion, entrants and the winner agree that the Promoter and each of the Released Parties are, to the extent permitted by law, not responsible for:
1. Lost, late, incomplete, stolen, misdirected, undeliverable e-mail notifications, or postal mail;
2. any computer, satellite, cable, network, electronic or Internet hardware or software malfunctions, failures, connections, or availability;
3. garbled, corrupt or jumbled transmissions, service provider/Internet/website/UseNet accessibility, availability or traffic congestion;
4. any technical, mechanical, printing or typographical or other error;
5. the incorrect or inaccurate capture of registration information or the failure to capture, or loss of, any such information;
6. any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, technical error, theft or destruction or unauthorized access to the Promotion;
7. any property damage, personal injury and/or death which may occur in connection with, preparation for, travel to, or participation in Promotion, or possession, acceptance and/or use or misuse of prize or participation in any Promotion-related activity and for any claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trademark infringement or any other intellectual property-related cause of action;
8. any and all federal, state and local taxes;
9. entries that are late, forged, lost, misplaced, misdirected, tampered with, incomplete, deleted, damaged, or otherwise not in compliance with the Terms & Conditions; and
10. for any loss (including, without limitation, indirect, special or consequential loss, punitive or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Promotion or accepting or using a Prize, except for any liability which cannot be excluded by law.

CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
The Promoter seeks to run a fair and secure promotion and prevent abuse and cheating. If you enter in a way that is not consistent with these Terms & Conditions, your entry/ies (and any of your associated aliases) will be disqualified. Any Prize awarded may be void and recoverable, and the Promoter reserves the right to bar you from entering future promotions for a period of at least six months. For this reason, the Promoter reserves the right at any point to:
1. Verify the eligibility of entrants and/or the provisional winner through multiple means by requesting such information it consider reasonably necessary for this purpose. Entry or a Prize may be withheld until verification is completed.
2. Disqualify entries that are not made directly by the individual entering the Promotion.
3. Disqualify entries made using anonymous email services such as, but not limited to, GuerillaMail, Dispostable or Mailinator.
4. Disqualify bulk entries from individuals, trade, consumer groups or third parties, incomplete entries and entries submitted by macros or other automated means.
5. Disqualify entries beyond the maximum allowed, or those using techniques such as ‘script’, ‘brute force’, masking identity by manipulating IP addresses, using aliases or identities other than their own or any other means.
6. Disqualify entrants who tamper with the entry process.
7. Disqualify entries which, in some other way, do not meet the requirements of these Terms & Conditions.
8. Cancel, modify or suspend the Promotion should it not be capable of running as planned for reasons including but not limited to tampering, unauthorised intervention, fraud, dishonesty, technical failures, or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, subject to the relevant State or Territory Regulation or Law. Any changes to the Terms & Conditions will be approved by the relevant Australian Authorities.
The Prize is not transferable or exchangeable and cannot be redeemed for monetary value or for any other form of compensation. If for any reason the Prize is not available, the Promoter reserves the right, at its sole discretion to substitute that Prize for another of equal or greater value.
The Promoter is not responsible for any undelivered messages or e-mails, including without limitation, e-mails that are not received because of an entrant’s privacy or spam filter settings that may divert any winner notification or other Promotion related e-mail to a spam or junk folder.
No responsibility can be taken for entries which are lost, delayed, corrupted, damaged, misdirected or incomplete or which cannot be delivered for any technical, delivery or other reason. Proof of sending will not be accepted as proof of receipt. The Promoter does not guarantee continuous or secure access to 444racingco website and the AMOE entry page.
By entering the Promotion, each entrant agrees: (i) to be bound by these Terms & Conditions; (ii) to waive any rights to claim ambiguity with respect to these Terms & Conditions; (iii) to the extent permitted by law, to waive all of their rights to bring any claim, action or proceeding against any of the Released Parties in connection with the Promotion; and (iv) to the extent permitted by law, to forever and irrevocably agree to release and hold harmless each of the Released Parties from any and all claims, lawsuits, judgments, causes of action, proceedings, demands, fines, penalties, liability, costs and expenses (including, without limitation, reasonable attorneys’ fees) that may arise in connection with: (a) the Promotion, including, but not limited to, any Promotion-related activity or element thereof, participation or inability to participate in the Promotion; (b) the violation of any third-party privacy, personal, publicity or proprietary rights; (c) acceptance, attendance at, receipt, travel related to, participation in, delivery of, possession, defects in, use, non-use, misuse, inability to use, loss, damage, destruction, negligence or wilful misconduct in connection with the use of a Prize (or any component thereof); (d) any change in the Promotion or prizing (or any components thereof); (e) human error; (f) any wrongful, negligent, or unauthorized act or omission on the part of any of the Released Parties; (g) lost, late, stolen, misdirected, damaged or destroyed prizing (or any element thereof); or (h) the negligence or wilful misconduct by the entrant.
If, for any reason, the Promotion is not capable of running as planned, or the integrity and or feasibility of the Promotion is severely undermined by any event beyond the control of the Promoter, the Promoter will not be liable for any failure to comply with their obligations or any delay in performing their obligations within these Terms & Conditions if an act, omission, event or circumstance occurs caused by (but not limited to) global or regional health crises, weather conditions, fire, flood, strike, hurricane, earthquake, explosion, industrial dispute, war, terrorist activity, any federal, state, provincial or local government law, order, or regulation, order of any court or jurisdiction, hostilities, political unrest, riots, civil commotion, epidemic, pandemic, famine, plague or other natural calamities and acts of God or any other circumstances beyond the reasonable control of the Promoter (each a “Force Majeure” event or occurrence).
All personal data supplied for this Promotion will be used for the purpose of this Promotion and for research and analytical purposes by the Promoter and/or by any agent appointed by it to assist with running the Promotion. Personal data will not be disclosed to an unconnected third party unless your positive consent has been obtained. If any part/s of these Terms & Conditions are legally ruled to be invalid, illegal or unenforceable, the remainder will not be affected and will continue in full force and effect.
By entering, you will be deemed to have agreed to be bound by these Terms & Conditions.
If there is a discrepancy between these Terms & Conditions and those in any promotional material, these Terms & Conditions will prevail.
For Australian, UK, Swiss, German and French Residents: These Terms and Conditions shall be governed by the law of the relevant country for each entrant, and entrants submit to the exclusive jurisdiction of the courts of the relevant country they reside in.
For USA Residents only: The parties waive all rights to trial in any action or proceeding instituted in connection with these Terms & Conditions, including, without limitation, the Promotion. Any controversy or claim arising out of or relating to these Terms & Conditions and/or the Promotion shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in the State of California.
For USA Residents only: THESE TERMS & CONDITIONS AND THE INTERPRETATION OF THEIR TERMS SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF CALIFORNIA WITHOUT REGARD TO ITS CONFLICTS OF LAWS RULES. For any matters which are not subject to arbitration as set forth in these Terms & Conditions and/or in connection with the entering of any judgement on an arbitration award in connection with these Terms & Conditions and/or the Promotion, the parties irrevocably submit and consent to the exclusive jurisdiction and venue of the state and federal courts located in in the State of California. The parties agree not to raise the defense of forum non conveniens.

Le fait que l’Organisateur n’applique pas une disposition des présentes Conditions Générales ne constitue pas une renonciation à cette disposition, laquelle demeurera pleinement en vigueur. En cas de conflit entre les détails de l’Opération contenus dans les présentes Conditions Générales et les détails de l’Opération contenus dans tout support promotionnel (y compris, mais sans s’y limiter, la publicité sur le lieu de vente, à la télévision et dans la presse, ou tout autre support promotionnel), les détails de l’Opération tels qu’énoncés dans les présentes Conditions Générales prévaudront.
Limitation de responsabilité pour les résidents australiens, britanniques, suisses, allemands et français : en participant à cette Opération, les participants et le gagnant acceptent que l’Organisateur et chacune de leurs sociétés affiliées, filiales, représentants, consultants, sous-traitants, conseillers juridiques, agences de publicité, de relations publiques, de fulfilment et de marketing, fournisseurs de sites web respectifs et chacun de leurs dirigeants, administrateurs, actionnaires, employés, représentants, délégués et agents respectifs (les « Parties Exonérées » / « Released Parties ») n’assument aucune responsabilité pour toute perte (y compris, sans limitation, toute perte indirecte, spéciale ou consécutive ou perte de profits), dépense ou dommage subi ou supporté (résultant ou non de la négligence d’une personne) en lien avec cette Opération ou l’acceptation ou l’utilisation du/d’un Prix, à l’exception de toute responsabilité ne pouvant être exclue par la loi. Rien n’exclut la responsabilité des Parties Exonérées en cas de décès ou de préjudice corporel résultant de la négligence des Parties Exonérées.
Limitation de responsabilité pour les résidents des États-Unis : en participant à cette Opération, les participants et le gagnant acceptent que l’Organisateur et chacune des Parties Exonérées ne soient pas responsables, dans la mesure permise par la loi, de :
1. toute notification par e-mail ou courrier postal perdue, en retard, incomplète, volée, mal acheminée ou non distribuable ;
2. tout dysfonctionnement, panne, connexion ou disponibilité de matériel ou de logiciel informatique, satellite, câble, réseau, électronique ou Internet ;
3. les transmissions brouillées, corrompues ou mélangées, l’accessibilité, la disponibilité ou la congestion du trafic du fournisseur de services/d’Internet/du site web/de UseNet ;
4. toute erreur technique, mécanique, d’impression, typographique ou autre ;
5. la saisie incorrecte ou inexacte des informations d’inscription ou l’absence de saisie ou la perte de ces informations ;
6. toute erreur, omission, interruption, suppression, défaut, retard de fonctionnement ou de transmission, panne de ligne de communication, erreur technique, vol ou destruction ou accès non autorisé à l’Opération ;
7. tout dommage matériel, préjudice corporel et/ou décès pouvant survenir en lien avec la préparation de l’Opération, le déplacement vers celle-ci ou la participation à celle-ci, ou la possession, l’acceptation et/ou l’utilisation ou la mauvaise utilisation du prix ou la participation à toute activité liée à l’Opération, ainsi que pour toute réclamation fondée sur les droits de publicité, la diffamation, l’atteinte à la vie privée, la violation de droits d’auteur, la contrefaçon de marque ou toute autre cause d’action liée à la propriété intellectuelle ;
8. tous impôts fédéraux, d’État et locaux ;
9. les participations en retard, falsifiées, perdues, égarées, mal acheminées, altérées, incomplètes, supprimées, endommagées ou autrement non conformes aux Conditions Générales ; et
10. toute perte (y compris, sans limitation, toute perte indirecte, spéciale ou consécutive, punitive ou perte de profits), dépense ou dommage subi ou supporté (résultant ou non de la négligence d’une personne) en lien avec cette Opération ou l’acceptation ou l’utilisation d’un Prix, à l’exception de toute responsabilité ne pouvant être exclue par la loi.
CETTE OPÉRATION ET TOUS LES PRIX SONT FOURNIS « EN L’ÉTAT » SANS GARANTIE D’AUCUNE SORTE, EXPRESSE OU IMPLICITE, Y COMPRIS, MAIS SANS S’Y LIMITER, LES GARANTIES IMPLICITES DE QUALITÉ MARCHANDE, D’ADÉQUATION À UN USAGE PARTICULIER OU D’ABSENCE DE CONTREFAÇON. CERTAINES JURIDICTIONS PEUVENT NE PAS AUTORISER LES LIMITATIONS OU L’EXCLUSION DE RESPONSABILITÉ POUR LES DOMMAGES ACCESSOIRES OU CONSÉCUTIFS OU L’EXCLUSION DES GARANTIES IMPLICITES, DE SORTE QUE CERTAINES DES LIMITATIONS OU EXCLUSIONS CI-DESSUS PEUVENT NE PAS VOUS ÊTRE APPLICABLES. VÉRIFIEZ VOS LOIS LOCALES POUR TOUTE RESTRICTION OU LIMITATION CONCERNANT CES LIMITATIONS OU EXCLUSIONS.
ATTENTION : TOUTE TENTATIVE D’UN PARTICIPANT D’ENDOMMAGER DÉLIBÉRÉMENT UN SITE WEB OU DE COMPROMETTRE LE FONCTIONNEMENT LÉGITIME DE L’OPÉRATION PEUT CONSTITUER UNE VIOLATION DES LOIS PÉNALES ET CIVILES ET, EN CAS DE TELLE TENTATIVE, L’ORGANISATEUR SE RÉSERVE LE DROIT DE DEMANDER DES DOMMAGES ET INTÉRÊTS À CETTE PERSONNE DANS TOUTE LA MESURE PERMISE PAR LA LOI.
L’Organisateur s’efforce de mener une opération équitable et sécurisée et de prévenir les abus et la triche. Si vous participez d’une manière non conforme aux présentes Conditions Générales, votre/vos participation(s) (et tous vos alias associés) seront disqualifiées. Tout Prix attribué pourra être annulé et récupéré, et l’Organisateur se réserve le droit de vous interdire de participer à de futures opérations pendant une période d’au moins six mois. Pour cette raison, l’Organisateur se réserve le droit à tout moment de :
1. vérifier l’éligibilité des participants et/ou du gagnant provisoire par divers moyens en demandant les informations qu’il juge raisonnablement nécessaires à cette fin. La participation ou un Prix pourra être retenu jusqu’à ce que la vérification soit terminée ;
2. disqualifier les participations qui ne sont pas effectuées directement par la personne participant à l’Opération ;
3. disqualifier les participations effectuées à l’aide de services de messagerie anonymes tels que, mais sans s’y limiter, GuerillaMail, Dispostable ou Mailinator ;
4. disqualifier les participations en masse provenant de particuliers, de professionnels, de groupes de consommateurs ou de tiers, les participations incomplètes et les participations soumises par des macros ou d’autres moyens automatisés ;
5. disqualifier les participations au-delà du maximum autorisé, ou celles utilisant des techniques telles que les « scripts », la « force brute », la dissimulation d’identité par la manipulation d’adresses IP, l’utilisation d’alias ou d’identités autres que la leur ou tout autre moyen ;
6. disqualifier les participants qui altèrent le processus de participation ;
7. disqualifier les participations qui, d’une autre manière, ne satisfont pas aux exigences des présentes Conditions Générales ;
8. annuler, modifier ou suspendre l’Opération si elle ne peut se dérouler comme prévu pour des raisons incluant, mais sans s’y limiter, l’altération, l’intervention non autorisée, la fraude, la malhonnêteté, les défaillances techniques ou toute autre cause échappant au contrôle de l’Organisateur qui corrompt ou affecte l’administration, la sécurité, l’équité, l’intégrité ou le bon déroulement de cette Opération, sous réserve de la réglementation ou de la législation de l’État ou du Territoire concerné. Toute modification des Conditions Générales sera approuvée par les autorités australiennes compétentes.
Le Prix n’est ni transférable ni échangeable et ne peut être échangé contre une valeur monétaire ou toute autre forme de compensation. Si, pour une raison quelconque, le Prix n’est pas disponible, l’Organisateur se réserve le droit, à sa seule discrétion, de remplacer ce Prix par un autre de valeur égale ou supérieure.
L’Organisateur n’est pas responsable des messages ou e-mails non distribués, y compris, sans limitation, les e-mails qui ne sont pas reçus en raison des paramètres de confidentialité ou de filtrage anti-spam d’un participant susceptibles de rediriger toute notification de gain ou tout autre e-mail lié à l’Opération vers un dossier de spam ou de courrier indésirable.
Aucune responsabilité ne peut être assumée pour les participations perdues, retardées, corrompues, endommagées, mal acheminées ou incomplètes ou qui ne peuvent être remises pour toute raison technique, de livraison ou autre. La preuve d’envoi ne sera pas acceptée comme preuve de réception. L’Organisateur ne garantit pas un accès continu ou sécurisé au site web 444racingco et à la page de participation AMOE.
En participant à l’Opération, chaque participant accepte : (i) d’être lié par les présentes Conditions Générales ; (ii) de renoncer à tout droit d’invoquer une ambiguïté concernant les présentes Conditions Générales ; (iii) dans la mesure permise par la loi, de renoncer à tous ses droits d’intenter toute réclamation, action ou procédure contre l’une des Parties Exonérées en lien avec l’Opération ; et (iv) dans la mesure permise par la loi, d’accepter pour toujours et irrévocablement de décharger et de garantir chacune des Parties Exonérées contre toutes réclamations, poursuites, jugements, causes d’action, procédures, demandes, amendes, pénalités, responsabilités, coûts et dépenses (y compris, sans limitation, les honoraires d’avocat raisonnables) pouvant survenir en lien avec : (a) l’Opération, y compris, mais sans s’y limiter, toute activité liée à l’Opération ou tout élément de celle-ci, la participation ou l’impossibilité de participer à l’Opération ; (b) la violation de tout droit de tiers relatif à la vie privée, aux droits de la personnalité, de publicité ou de propriété ; (c) l’acceptation, la présence, la réception, les déplacements liés, la participation, la livraison, la possession, les défauts, l’utilisation, la non-utilisation, la mauvaise utilisation, l’impossibilité d’utilisation, la perte, le dommage, la destruction, la négligence ou la faute intentionnelle en lien avec l’utilisation d’un Prix (ou de tout élément de celui-ci) ; (d) tout changement dans l’Opération ou les prix (ou tout élément de ceux-ci) ; (e) l’erreur humaine ; (f) tout acte ou omission illicite, négligent ou non autorisé de la part de l’une des Parties Exonérées ; (g) les prix (ou tout élément de ceux-ci) perdus, en retard, volés, mal acheminés, endommagés ou détruits ; ou (h) la négligence ou la faute intentionnelle du participant.
Si, pour une raison quelconque, l’Opération ne peut se dérouler comme prévu, ou si l’intégrité et/ou la faisabilité de l’Opération sont gravement compromises par un événement échappant au contrôle de l’Organisateur, l’Organisateur ne sera pas responsable de tout manquement à ses obligations ou de tout retard dans l’exécution de ses obligations au titre des présentes Conditions Générales si un acte, une omission, un événement ou une circonstance survient causé par (mais sans s’y limiter) des crises sanitaires mondiales ou régionales, des conditions météorologiques, un incendie, une inondation, une grève, un ouragan, un tremblement de terre, une explosion, un conflit social, une guerre, une activité terroriste, toute loi, ordonnance ou réglementation gouvernementale fédérale, étatique, provinciale ou locale, toute décision d’un tribunal ou d’une juridiction, des hostilités, des troubles politiques, des émeutes, des troubles civils, une épidémie, une pandémie, une famine, un fléau ou d’autres calamités naturelles et cas de force majeure ou toute autre circonstance échappant au contrôle raisonnable de l’Organisateur (chacun un événement ou une occurrence de « Force Majeure »).
Toutes les données personnelles fournies dans le cadre de cette Opération seront utilisées aux fins de cette Opération et à des fins de recherche et d’analyse par l’Organisateur et/ou par tout agent désigné par lui pour l’assister dans la conduite de l’Opération. Les données personnelles ne seront pas divulguées à un tiers non lié, sauf si votre consentement explicite a été obtenu. Si une ou plusieurs parties des présentes Conditions Générales sont juridiquement déclarées invalides, illégales ou inapplicables, le reste n’en sera pas affecté et restera pleinement en vigueur.
En participant, vous serez réputé avoir accepté d’être lié par les présentes Conditions Générales.
En cas de divergence entre les présentes Conditions Générales et celles figurant dans tout support promotionnel, les présentes Conditions Générales prévaudront.
Pour les résidents australiens, britanniques, suisses, allemands et français : les présentes Conditions Générales sont régies par le droit du pays concerné de chaque participant, et les participants se soumettent à la compétence exclusive des tribunaux du pays dans lequel ils résident.
Pour les résidents des États-Unis uniquement : les parties renoncent à tous leurs droits à un procès dans toute action ou procédure engagée en lien avec les présentes Conditions Générales, y compris, sans limitation, l’Opération. Tout litige ou toute réclamation découlant des présentes Conditions Générales et/ou de l’Opération ou s’y rapportant sera réglé par arbitrage contraignant conformément aux règles d’arbitrage commercial de l’American Arbitration Association. Tout litige ou toute réclamation de ce type sera arbitré sur une base individuelle et ne sera consolidé dans aucun arbitrage avec une réclamation ou un litige d’une autre partie. L’arbitrage se déroulera dans l’État de Californie.
Pour les résidents des États-Unis uniquement : LES PRÉSENTES CONDITIONS GÉNÉRALES ET L’INTERPRÉTATION DE LEURS TERMES SONT RÉGIES PAR LES LOIS DE L’ÉTAT DE CALIFORNIE ET INTERPRÉTÉES CONFORMÉMENT À CELLES-CI, SANS ÉGARD À SES RÈGLES DE CONFLITS DE LOIS. Pour toute question non soumise à l’arbitrage tel que prévu dans les présentes Conditions Générales et/ou en lien avec l’inscription de tout jugement relatif à une sentence arbitrale en lien avec les présentes Conditions Générales et/ou l’Opération, les parties se soumettent et consentent irrévocablement à la compétence exclusive et au ressort des tribunaux d’État et fédéraux situés dans l’État de Californie. Les parties conviennent de ne pas soulever l’exception de forum non conveniens.
